This legislation would prohibit insurers, delivering a group or blanket health care policy that includes coverage for prescription drugs, from excluding from the dispensing of such prescription drugs, any pharmacy willing to meet the terms and conditions of the contracts of any managed care pharmacy program or network of pharmacies dispensing prescription drugs. The Pharmacists Society of the State of New York and the Pharmacists' Association of Western New York strongly support this legislation and urges its passage by the Legislature.

In a recent poll of over 1,000 adults, 84% said that they want to keep the right to select their own pharmacy. A full 58% said this right is very important to them. Just as people want to choose their physicians, consumers want to select their pharmacists.

We urge the Legislature to protect the right of pharmacies to have full access to the marketplace and to take advantage of the one truly competitive market in health care delivery — community pharmacy. This requires that all pharmacies have an opportunity to fill a patient’s prescriptions and to let the consumer decide which pharmacy provides the right mix of service, convenience and price to best meet the consumer’s needs.
